【 楽曲使用条件 】

本楽曲は、作曲家「さんうさぎ」が自ら作曲・制作し、配布しています。利用者 は以下に定める楽曲使用条件（以下「本楽曲利用条件」といいます。）に基づいて本楽曲 を利用することができます。なお、利用者による音源の利用をもって、本楽曲使用条件に 同意したものとみなします。

 【権利の帰属・管理等 】

本楽曲に発生する著作権、著作隣接権その他著作権法を含む知的財産法上の一切の権利は、 「さんうさぎ」に帰属します。本楽曲利用条件は、以下の条件で利用者が本楽曲 を利用することを許諾するものであり、本楽曲の権利の一切を譲渡・移転するものではあ りません。なお、本楽曲は「さんうさぎ」自身が管理する楽曲であり、JASRAC などの著作権等管理事業者に管理を委託するものではありません。 

【利用条件】 

・映像やライブ配信、Podcast やドラマCD などの音声制作物、もしくは空間のBGM として利用してください。 

・個人・法人、商用・非商用に関わらず利用できます。 ・著作権使用料その他の費用は無償です。 

・利用時のクレジット表記、「さんうさぎ」への報告は不要です。 

・利用期限、利用回数の制限はありません。 

・加工（フェードイン・アウト、ループ、カット、音量・音質調整等）が可能です。 

【音楽作品での追加利用条件】

 本楽曲を原曲とした音楽作品（以下「音楽作品」といいます。）を制作するに際しては、

【禁止事項】

 利用者は、本楽曲の利用に関し、 「さんうさぎ」に無断で以下の行為を行うこと はできません。 利用者が「「さんうさぎ」に無断で以下の行為を行った場合、「さんうさ ぎ」は利用者に対し本楽曲の利用許諾を遡って取り消すとともに、利用者が制作した音楽 作品の配信停止、音楽作品の収益化の停止、その他UGC サービス上で取りうる措置を含 む一切の措置を取ることができるものとします。 

・本楽曲を主たるコンテンツとした動画・静止画の配信その他の利用 

（例）本楽曲を視聴させることを主たる目的とした、ループアニメーションなどの映 像作品への本楽曲の利用 

・＜音楽作品での追加利用条件＞を満たさない態様で音楽作品に利用すること (① を満たさない例）本楽曲に音楽としての創作性を追加していない、ミックス調整 版やループ版、作業用BGM 集などとしての配信その他の利用 (② を満たさない例）UGC サービス以外の媒体での配信・販売・上演等の利用 （Apple Music や Spotify 等での配信や Shazam 等音楽認識サービスへの登録、 BGM としての配信、CD やオルゴールなど有体物の販売などを含みますがこれに限ら れません。） 

・その他＜音楽作品での利用条件＞で許可されている範囲を超えて、音楽作品に本楽曲 の全部または一部を利用すること 

・本楽曲または本楽曲を含む音楽作品その他の制作物を、音楽として YouTube のコン テンツID 等のフィンガープリントに登録すること 

・本楽曲または本楽曲を含む音楽作品その他の制作物をJASRAC 等の著作権管理団体に 登録する行為 

・本楽曲のジャケット画像、MV に含まれる映像を利用すること 

・本楽曲の権利者を偽称・僭称する行為 

・本楽曲を誹謗中傷する目的で配信する行為 

・宗教及び政治に関わる内容を含んだ動画で楽曲を利用すること 

・第三者に対して本楽曲の音源や楽譜を再利用許諾、再配布、譲渡、貸与、転売するこ と 

・法令に違反する行為又は違反の恐れのあること 

・公序良俗に反する行為又は犯罪を助長するようなこと 

・「さんうさぎ」の名誉や信用を毀損する恐れのあること 

【免責】 

「さんうさぎ」は、本楽曲の利用に関連して利用者が被った損害について、一切 賠償の責任を負いません。 

【配信の停止】

  「さんうさぎ」は、本楽曲の配信をいつでも予告なしに停止する権利を有するも のとします。ただし、利用者は、本楽曲を配信停止時までにダウンロードした楽曲を、本 楽曲利用条件の下で継続して利用することができます。 

【本楽曲利用条件の変更 】

「さんうさぎ」が必要と判断した場合には、利用者の事前の承諾を得ることなく、 本楽曲利用条件を変更することができるものとし、変更後にダウンロードした楽曲につい ては変更後の本楽曲利用条件が適用されるものとします。なお、「さんうさぎ」 は、本楽曲利用条件を変更した場合はその内容を改訂履歴として掲示します。 

【準拠法及び管轄裁判所】

 本楽曲利用条件の成立、履行および解釈に関しては、日本法を準拠法とし、紛争が生じた 場合は、東京地方裁判所を第一審の専属管轄裁判所とします。

【Terms of Use】

 The musical compositions distributed on this webpage (the “Music”) are composed, produced, and distributed by the composer Sanusagi (“さんう さぎ” in Japanese) himself. You may use the Music in accordance with these terms and conditions of use (“Terms of Use”). By using the Music, you are deemed to have agreed to these Terms of Use. 

【Ownership and Management of Rights, etc.】

 All copyrights, neighboring rights, and any other rights under intellectual property laws including [Japan’s] Copyright Act that arise from the Music belong to Sanusagi. These Terms of Use grant you, the user, permission to use the Music under the following conditions, and do not transfer or assign any rights in or to the Music. The Music is managed by Sanusagi himself and has not been entrusted to any collective management organization of copyrights and related rights (each, a “CMO”) such as JASRAC.

【 General Terms】 

・You may use the Music in audio productions such as videos, live streamings, podcasts, drama CDs, or as background music. 

・You may use the Music for both personal and corporate as well as commercial and non-commercial purposes. 

・No copyright royalties or other fees will be charged. ・No credit or notification is required at the time of use. ・There is no limitation on the usage period or the number of times of usage. 

・You may process the Music, such as fade in/out, looping, cutting, volume and sound quality adjustment, etc. 

【Additional Terms for Musical Works】 When you produce a musical work based on the Music (the “Musical Work"), you may use the Music on complying with both (i) and (ii) below: (i) Adding musical creativity to the Music, such as covering, arranging, singing, sampling, etc. (ii) Distributing the Musical work on a user-generated, free-to-view internet service such as YouTube, Twitter, etc. (the “UGC Services”) Also the credit is required for the Musical Work. 

【Prohibitions】

You must not engage in any of the following acts in connection with the usage of the Music without the prior consent of  Sanusagi. If you engage in any of the following acts without the prior consent of  Sanusagi,  Sanusagi may retroactively revoke your license under these Terms of Use, suspend the distribution of the Musical Works you created, suspend monetization from the Musical Works, and take any other actions, including actions that may be taken on the UGC Services. 

・Distribute or other use of videos or still images which include the Music as the main content: 

(Ex:) Use of the Music in a video work, such as a loop animation, whose main purpose is to make the audience listen and/or access the Music. 

・Use of the Music in a manner that does not satisfy item (i) and item (ii) of the Additional Terms for Musical Works. 

(Example of not satisfying item (i): Distribution or other use of the Music as a mix adjustment version, loop version, or collection of background music for work, etc., which does not add musical creativity to the Music. (Example of not satisfying item (ii)) Distribution, sale, performance, or other use on media other than UGC services (including but not limited to distribution on Apple Music, Spotify, etc., registration with music recognition services such as Shazam, distribution as background music, sale of tangible goods such as CDs and music boxes, etc.). 

・Use of the Music, in whole or in part, in a Musical Work beyond the scope permitted in the "Additional Terms for Musical Works" section. 

・Registering the Music or any Musical Work or other production containing the Music as music in the fingerprints of YouTube content IDs, etc 

・Registering the Music or any Musical Work or other production containing the Music with JASRAC or any other CMOs. 

・Use of the artwork and footage in the music video of the Music 

・Misrepresenting or pretending to be the owner of the rights to the Music. 

・Distributing the Music for the purpose of slandering or defaming the Music. 

・Use of music in videos containing religious or political content. 

・Licensing, (re)distribution, transfer, loan, or resale of the sound source or score of the Music itself to a third party.

・Violation or threat of violation of laws and regulations. 

・Any act that offends public order and morals or encourages crimes. 

・Any act that may damage the reputation or credibility of  Sanusagi.

【 Waiver】

  Sanusagi will not be liable for any damages you may incur in connection with the use of the Music. 

【Unsubscribe】 

Sanusagi reserves the right to unsubscribe the Music at any time without notice. However, you may continue to use the Music downloaded up to the time of being unsubscribed under these Terms of Use. 

【Changes to Terms of Use】 

Sanusagi reserves the right to revise these Terms of Use without prior consent of the User, whenever such revisions is considered necessary by Sanusagi. The revised version of these Terms of Use will apply to the Music downloaded after the revision. Sanusagi will post a revised version of these Terms of Use as revision history if any revisions are made on these Terms of Use.

【 Governing Law and Jurisdiction】

 The formation, performance, and interpretation of these Terms of Use will be governed by the laws of Japan, and in the event of any dispute, the Tokyo District Court will have exclusive jurisdiction as the court of first instance.

【 Language】

 The original text of the Terms of Use will be prepared in Japanese. Only the Japanese language version will be effective as the legally terms, and this translation shall be supplied for only reference use.
